Introduction

Welcome to Nirvana Gold, a cannabis and wellness affiliate marketing program operated by CN Marketing, LLC, a licensed Arizona-based company. These Terms of Service ("Agreement") govern your participation in the Nirvana Gold Affiliate Program ("Program") and your use of our website and related services. By accessing or using our services, you agree to be bound by these terms.

Legal Disclosures for Arizona Residents

• You must be 21 years of age or older to participate in this affiliate program, in accordance with Arizona Revised Statutes Title 36, Chapter 28.1 (Arizona Medical Marijuana Act).
• All affiliate activities must comply with local municipal ordinances and zoning laws regarding the advertisement or promotion of cannabis products.
• Affiliates may only promote products in jurisdictions where cannabis marketing is legal and must avoid any cross-state commerce that violates federal law.
• Affiliates are strictly prohibited from promoting cannabis products to out-of-state consumers where cannabis is illegal.
• Affiliates must comply with all relevant Arizona laws and regulations, including the Arizona Administrative Code Title 9, Chapter 17 (Arizona Department of Health Services Medical Marijuana Program).

Eligibility and Registration

To join Nirvana Gold, you must register an affiliate account by providing complete and accurate information, including legal name, address, phone number, and government-issued identification. We reserve the right to approve or reject applications at our discretion. By registering, you confirm you are not a minor under the laws of your jurisdiction and that you are legally able to enter into binding contracts.

Onboarding Fee

A one-time $200 onboarding fee is required to activate your affiliate account. This fee grants access to training modules, affiliate resources, and platform tools. The fee is non-refundable except as required under Arizona's consumer protection laws (Arizona Consumer Fraud Act).

Commission Structure

Affiliates earn commission on qualifying sales made through their unique referral links. The current commission rate and payout structure are available in your affiliate dashboard and may be adjusted with 30 days' notice. Payments are made via direct deposit or PayPal and require submission of a W-9 form as required by the Internal Revenue Service (IRS).

Prohibited Conduct

Affiliates may not engage in any of the following:

• Unlawful, misleading, or deceptive advertising.
• Promoting cannabis or CBD as a medical treatment or cure unless FDA approved.
• Using paid ads that impersonate Nirvana Gold or CN Marketing.
• Using spam tactics or unauthorized mass messaging.
• Promoting to individuals under 21 or in prohibited states.

Marketing Compliance

Affiliates are required to include proper disclaimers in all promotional materials, such as: "These statements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease." Failure to comply may result in immediate termination of your affiliate account.

Affiliate Responsibilities

As an affiliate, you are an independent contractor. You are solely responsible for the legality of your promotional methods and must comply with all FTC guidelines on affiliate disclosures, including prominently stating your affiliation with Nirvana Gold in all social media posts, emails, and web content.

Data and Privacy

Data and Privacy

CN Marketing collects and stores user data in accordance with our Privacy Policy. Affiliates must not share or misuse customer data under any circumstances. Affiliates may not use third-party cookies or tracking without explicit consent.

Termination and Suspension

We may suspend or terminate your participation in the Program at any time for cause, including but not limited to violation of these terms, breach of contract, or illegal activity. Upon termination, any unpaid commissions may be withheld if earned through prohibited conduct.

Taxes

Affiliates are solely responsible for reporting and paying all applicable federal, state, and local taxes. CN Marketing will issue 1099 forms to U.S.-based affiliates earning over $600 in a calendar year. Arizona Department of Revenue guidelines may also apply.

Dispute Resolution

This Agreement is governed by Arizona law. Any disputes will be resolved via binding arbitration held in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association (AAA). You waive your right to a jury trial or class action.

Modifications

We reserve the right to modify these Terms of Service at any time. Notice of significant changes will be sent via email or posted on our website. Your continued participation in the Program constitutes acceptance of the updated terms.
